Terms and Conditions


Defines, among others, the rules of concluding sales contracts through the shop, containing the most important information about the Seller, shop and consumer rights.

§ 1 DEFINITIONS
Working days - days from Monday to Friday except for public holidays.
Account - a free function of the Store (service provided electronically) regulated by separate regulations, thanks to which the Buyer may open his or her own individual Account in the Store.
Consumer - Consumer as defined by the provisions of the Civil Code.
Buyer - any entity of the Buyer in the Store.
Regulations - these regulations.
Shop - Potfurry Internet shop run by the Seller at www.potfurry.com . 
Seller - Potfurry sp. z o.o. with its registered office at  Marszałkowska street 89, 00-693 Warsaw, Poland, entered into the National Court Register - register of entrepreneurs by the District Court for the Capital City of Warsaw.  XII Department of Economy of the National Court Register, under KRS number 0000706017, NIP 5223105804, REGON number 368827332.

§ 3 TECHNICAL REQUIREMENTS
1. For the proper functioning of the Store it is necessary:
 -Device with Internet access
 -Web browser that supports JavaScript and cookies.
2. In order to place an order in the Shop, in addition to the requirements specified in paragraph 1, an active e-mail account is required.

§ 4 SHOPPING IN THE STORE
1. The prices of the goods shown in the Store are the total prices of the goods, including VAT.
2. The Seller notes that the total price of the order consists of the price for the goods indicated in the Store and, if applicable, the cost of delivery of the goods.
3. You should add the chosen product to the basket in the Shop.
4. The Buyer then selects from the following available in the Store: the method of delivery of goods and the method of payment for the order, and also provides data necessary to complete the order.
5. Order is placed at the moment of confirmation of its content and acceptance of the Regulations by the Buyer.
6. Placing an order is the same as concluding a sales contract between the Buyer and the Seller.
7. The Seller shall provide the Consumer with the confirmation of the conclusion of the contract of sale on a durable medium at the latest at the time of delivery of the goods.
8. The Buyer may register in the Shop, i.e. set up an Account in the Shop or make purchases without registration by providing their data in each possible order.

§ 5 PAYMENTS
1. The order can be paid for at the Buyer's discretion:
 - with PayPal 
2. If the Buyer chooses to pay in advance, the order must be paid for within 3 working days after the order has been placed.
3. The merchant informs that in the case of certain payment methods, due to their specific nature, payment by this method is only possible immediately after the order has been placed.
4. Buyer making purchases in the Shop accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw his acceptance.

§ 6 ORDER FULFILLMENT
1. The Seller shall be obliged to deliver goods without defects.
2. The date of order completion is indicated in the Store.
3. If the Buyer has chosen to pay in advance for the order, the Seller shall proceed to the execution of the order after its payment.
4. In the event that within one order the Buyer purchased goods with different lead times, the order will be completed on the date appropriate for goods with the longest lead times.
5. The goods are delivered exclusively on the territory of Germany and Poland.
6. Goods purchased in the Store are delivered through a courier company chosen by the Buyer: DPD, GLS, UPS (depends on country of delivery).


§ 7 RIGHT OF WITHDRAWAL
1. The Consumer has the right to withdraw from the contract concluded with the Seller through the Store, subject to § 8 of the Regulations, within 14 days without giving any reason.

2. The period to withdraw from the contract expires after 14 days from the date:
 - In which the Consumer came into possession of the goods or in which a third party other than the carrier and indicated by the Consumer came into possession of the goods.
 - In which the Consumer came into possession of the last item or in which a third party, other than the carrier and indicated by the Consumer, came into possession of the last item in the case of a contract requiring the transfer of ownership of several items which are delivered separately.

3. In order to exercise the right of withdrawal, the Consumer must inform the Seller, using the data given in § 2 of the Regulations, of his decision to withdraw from the contract by way of an unambiguous statement (for example, a letter sent by post or information sent by e-mail).
4. The consumer may use the model withdrawal form placed at the end of the Terms and Conditions, but it is not mandatory.
5. In order to keep the deadline for withdrawal from the contract, it is sufficient that the Consumer sends information concerning the exercise of his right to withdraw from the contract before the expiry of the deadline for withdrawal from the contract.

CONSEQUENCES OF WITHDRAWAL FROM THE CONTRACT


1. In case of withdrawal from the contract, the Seller shall return to the Consumer all payments received from him, including the costs of delivery of goods (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest usual method of delivery offered by the Seller), immediately, and in any case no later than 14 days from the date on which the Seller was informed about the decision of the Consumer to exercise the right of withdrawal.
2. The Seller shall reimburse the payment using the same methods of payment as those used by the Consumer in the original transaction, unless the Consumer agrees to a different solution, in any case the Consumer shall not bear any fees in connection with this reimbursement. If it is necessary to refund funds for a transaction made by the customer with a payment card, the seller of the refund made to a bank account assigned to the payment card of the Customer.
3. The Seller may withhold the return of payment until the goods have been received or until proof of return has been provided, whichever is the earlier.
4. The Seller asks to return the goods to the address: Marszałkowska street 89, 00-693 Warsaw, Poland immediately, and in any case not later than 14 days from the date on which the Consumer informed the Seller of the withdrawal from the contract of sale. The deadline is met if the Consumer sends back the goods before the expiry of the deadline of 14 days.
5. The consumer shall bear the direct costs of returning the goods.
6. The consumer shall be liable only for any reduction in the value of the goods resulting from their use in a manner other than that necessary to determine the nature, characteristics and functioning of the goods.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
1. The right of withdrawal from a distance contract shall not be granted to the consumer in respect of the contract:
 - In which the subject matter of the service is an unprefabricated item, manufactured according to the Consumer's specification or intended to satisfy his individual needs.
 - Where the subject-matter of the supply is goods which, after delivery, by their nature, are inseparably connected with other goods.
2. No person other than the consumer shall have a right of withdrawal from a distance contract.


§ 9 COMPLAINTS
1. In the event of a defect in the goods, the Buyer has the right to complain about the defective goods on the basis of the warranty or guarantee regulated in the Civil Code, if the guarantee was granted.
2. Using the warranty, the Buyer may, on terms and on dates specified in the Civil Code:
- Submit a statement of price reduction
- In the case of a material defect - submit a statement of withdrawal from the contract
- Demand a replacement for a defect-free item
- Requirement to have the defect rectified
3. The Seller requests that a complaint be lodged on the basis of a warranty to the postal or electronic address indicated in § 2 of the Regulations.
4. If it turns out that it is necessary to deliver the goods to the Seller in order to investigate the complaint, the Buyer shall be obliged to deliver the goods, in the case of the Consumer at the Seller's expense, to the address Marszałkowska street 89, 00-693 Warsaw.
5. Complaints concerning the operation of the Store should be sent to the e-mail address indicated in § 2 of the Regulations.
6. Consideration of the complaint by the Seller will take place within 14 days.

 

§ 10 PERSONAL DATA

1. The administrator of personal data provided by the Buyer while using the Store is the Seller.

2. The Buyer's personal data is processed on the basis of a contract and for the purpose of its implementation, in accordance with the principles set out in the general regulation of the European Parliament and Council (EU) on data protection (RODO). Detailed information on data processing by the Seller is contained in the privacy policy published in the Shop.

§ 11 RESERVATIONS

1. It is forbidden for the Buyer to provide illegal content.

2. Each time an order is placed in the Store, it constitutes a separate sales agreement and requires separate acceptance of the regulations.  The agreement is concluded for the duration and purpose of the order.

3. Agreements concluded on the basis of these regulations are concluded in the English language.

4. In the event of any dispute with a Buyer who is not a Consumer, the competent court shall be the court having jurisdiction over the Seller's registered office.

5. None of the provisions of these regulations excludes or in any way limits the rights of the Consumer under the law.

§ 1 DEFINITIONS

Account - a free function of the Shop (service) regulated in these regulations, thanks to which the Buyer can open his own individual Account in the Shop.

Buyer - each Buyer's entity in the Store.

§ 3 TECHNICAL REQUIREMENTS

1. For the proper functioning and establishment of an Account it is necessary:

 - Active e-mail account

 - Device with Internet access

 - Web browser that supports JavaScript and cookies

§ 4  THE ACCOUNT

1. The opening of an Account is entirely voluntary and dependent on the will of the Buyer.

2. Account gives the Buyer additional possibilities, such as: viewing the history of orders placed by the Buyer in the Shop, checking the status of the order or independent edition of the Buyer's data.

3. In order to set up an Account, it is necessary to fill in an appropriate form in the Store.

4. At the moment of creating an Account, an agreement shall be concluded for an indefinite period of time between the Buyer and the Seller with respect to maintaining the Account in accordance with the principles set forth in the Regulations.

5. The Buyer may resign from the Account at any time without incurring any costs.

6. In order to resign from the Account, please send your resignation to the Seller at the e-mail address: office@potfurry.pl, which will result in the immediate removal of the Account and termination of the agreement with respect to maintaining the Account.

 

§ 5 COMPLAINTS

1. Complaints concerning the functioning of the Account should be sent to the e-mail address office@potfurry.pl

2. Consideration of the complaint by the Seller will take place within 14 days.

 

§ 6 PERSONAL DATA

§ 7 RESERVATIONS

1. It is forbidden for the Buyer to provide illegal content.

2. The Account Agreement shall be concluded in the English language.

3. If there are important reasons referred to in clause 4, the Seller shall have the right to amend these Account Regulations.

4. Important reasons referred to in sub-paragraph 3 are

 - the need to adapt the Store to the provisions of law applicable to the operations of the Store

 - improvement of the safety of the service provided

 - change of Account functionality requiring modification of Account rules and regulations.

5. The Buyer shall be informed about the planned change of the Account regulations at least 7 days before the change comes into force by e-mail sent to the address assigned to the Account.

6. If the Buyer does not express his acceptance of the planned change, he should inform the Seller about it by sending an appropriate message to the Seller's e-mail address office@potfurry.pl, which shall result in termination of the agreement with respect to maintaining the Account upon the entry into force of the planned change or earlier, if the Buyer makes such a request.

7. If the Buyer does not object to the planned change until it comes into force, it is assumed that he accepts it, which does not constitute any obstacle to the termination of the agreement in the future.

8. In case of a potential dispute with the Buyer who is not a Consumer, the competent court shall be the court competent for the seat of the Seller.

9. None of the provisions of these regulations excludes or in any way limits the rights of the Consumer resulting from the provisions of law.
